Thank you for using Simple Workout!

This document covers the Terms and Conditions ("Terms") of the Simple Workout App ("App"), including how your information is collected and stored. The developers of this app ("I", "we", "us", "our", "Company") encourage you to read this document carefully so you're fully aware of what you're signing up for. 

If you don't agree with any of the conditions herein, please do not use the App. By using the App you agree to be bound by the Terms. 

Your Account

You agree that the information you provide upon sign up of the App (in particular but not limited to your email address) belong to you. You agree that all information provided to us is current and accurate. You acknowledge that failure to do the above constitutes a breach of the Terms and that we may terminate your account. 

You agree that you're responsible for keeping confidential and otherwise safeguarding the password that you use to create your account, and that we are not responsible for any consequences that might arise from your password being compromised or disclosed to any third party.

You acknowledge that your Workout Data is being stored on device, and that loss of your device will result in a loss of your data. 

Purpose of the App

You agree to use the App solely for tracking your workout data and at your own risk. You acknowledge that at no time are we providing any fitness or medical advice through the App. You agree to consult a medical and fitness professional prior to conducting any fitness activity. You acknowledge that any workout activity that you may be tracking using the App carries risks including the risk of injury or death, and you assume all risks associated with any activity performed in conjunction with the use of the App.

We shall not be held liable of any damages, indirect or direct, related to or resulting from the use of the App, including injury or death. 

Availability For Use

We make no warranties of any kind to guarantee the availability or performance of the App. The App may not work as intended from time to time, may crash, may provide incorrect information, may result in the loss of any data you've keyed into the App or may be unavailable temporarily.

Fee

The App is provided with a free usage period to you following which a subscription fee ("Fee") will be charged which will be administered through the Apple App Store. You agree that we may from time to time, at a our sole discretion and without notice, revise the Fee, change the options provided to users (for instance but not limited to providing  monthly vs. quarterly vs. annual payment options), or otherwise modify the fee structure of the app. You agree to be responsible for managing your subscription through the Account Settings in your device, and that your subscription will auto-renew at regular intervals. You agree that any refund requests made by you will be considered by us at our sole discretion and you agree that any decisions we make regarding refunds will be final. 

 

Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

Termination

We may terminate your account at our discretion without prior notice for any reason whatsoever, including without limitation if you breach the Terms. If your account is terminated, you agree to make no further attempts to sign up again with different email and password credentials without first getting explicit permission from us. 

Intellectual Property

You agree that the App including all features, functionality, the App logo and any updates in the future will remain our intellectual property. You agree not to use or distribute our intellectual property without our expressed written consent. 

Limitation of Liability

You agree that we shall not be liable for any damages, whether direct, indirect or punitive, including without limitation any loss of money, data, goodwill or intangible losses resulting from your use of the App, any unauthorised use of the App by a third party, any malfunction of the App.

Other

These Terms shall be governed and construed in accordance with the laws of Singapore. Our failure to enforce any rights or provisions of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

This policy may be updated from time to time at our website. We reserve the right to change this policy at our discretion with no prior notice provided to you. You agree to be bound by the latest terms posted at our website.
